Jaffna, Sri Lanka – On this day, marking 17 years since the end of the war in Mullivaikkaal, we commemorate all the lives lost during the final phase of the armed conflict. We honor, in particular, the tens of thousands of Tamils killed in the brutal atrocities committed during the genocidal violence carried out by the Sri Lankan state during the final phase of the armed conflict.
17 years on, victims and survivors are still waiting for justice, accountability, and acknowledgement. Nearly two years after the National People’s Power government came to power promising system change, victims and survivors are still waiting for meaningful action. From its failed promise to repeal the Prevention of Terrorism Act, to its inaction on wartime atrocities, to its failure to ensure that civic space is free and safe, we have seen no substantive departure from previous governments.
Surveillance and intimidation persist despite the promise of a “New Era.” Journalists and activists who raise Tamil issues face ongoing harassment. Meanwhile, activists fighting against illegal land acquisitions and militarization remain under constant surveillance and often face the risk of arrest during protests. For years, families of the enforced disappeared have demanded answers about their forcibly disappeared loved ones, and the opening of the Chemmani mass grave without any concrete progress only adds to their anguish. The recent OHCHR report, “Accountability for Conflict-Related Sexual Violence in Sri Lanka,” serves as a stark reminder of the heinous sexual crimes committed against the Tamil people during the war. Victims and survivors of conflict-related sexual violence still await justice as the culture of impunity continues under the new government.
Justice cannot prevail where surveillance, intimidation, forced Sinhala-Buddhisization, and police brutality are normalized and masked as development and reconstruction. The government’s claim of strengthening existing institutions, like the Office on Missing Persons, as transitional justice measures, without ensuring justice and accountability for atrocity crimes committed during the armed conflict, shows that it remains on the same path of impunity as its predecessors.
17 years on, the Tamil polity’s determination to achieve justice and accountability remains steadfast in the face of incredible odds. Remembering those lost in Mullivaikkaal, the Adayaalam Centre for Policy Research stands resolute in its commitment to pursuing the justice and accountability owed to them, their next of kin, and the wider community.
17 ஆண்டுகள்: நிறைவேற்றப்படாத வாக்குறுதிகளும் தொடரும் தண்டனைவிலக்கும்
யாழ்ப்பாணம், இலங்கை – முள்ளிவாய்க்காலில் ஆயுத மோதல் முடிவுக்குக் கொண்டுவரப்பட்டு 17 ஆண்டுகள் நிறைவடையும் இந்நாளில், அந்த ஆயுத மோதலின் இறுதிக்கட்டத்தில் உயிரிழந்த அனைத்து உயிர்களையும் நாம் நினைவு கூருகிறோம். குறிப்பாக, ஆயுத மோதலின் இறுதிப் பகுதியில் இலங்கை அரசினால் முன்னெடுக்கப்பட்ட இனப்படுகொலையின் போது நிகழ்த்தப்பட்ட கொடூரமான வன்முறைகளில் கொல்லப்பட்ட பல்லாயிரக்கணக்கான தமிழ் மக்களுக்கு எமது அஞ்சலியைச் செலுத்துகிறோம்.
பதினேழு ஆண்டுகள் கடந்தும், பாதிக்கப்பட்டவர்களும் அதிலிருந்து தப்பிப்பிழைத்தவர்களும் நீதி, பொறுப்புக்கூறல் மற்றும் தமக்கு இழைக்கப்பட்ட அநீதிக்கான அங்கீகாரத்திற்காக இன்னும் காத்துக்கொண்டிருக்கிறார்கள். ‘முறைமை மாற்றம்’ (system change) ஒன்றைக் கொண்டுவருவதாக வாக்குறுதியளித்து, தேசிய மக்கள் சக்தி அரசாங்கம் ஆட்சிப் பொறுப்பேற்று இரண்டு ஆண்டுகள் நிறைவடையும் தருவாயிலும், பாதிக்கப்பட்டவர்களும் தப்பிப்பிழைத்தவர்களும் அர்த்தமுள்ள செயல்பாடுகளுக்காக இன்னமும் காத்துக்கொண்டிருக்கிறார்கள். பயங்கரவாதத் தடுப்புச் சட்டத்தை நீக்குவதாகக் கூறி நிறைவேற்றப்படாத வாக்குறுதி முதல், யுத்தகாலக் கொடூரங்கள் மீதான மந்தநிலை மற்றும் சிவில் சமூக வெளியைப் பாதுகாப்பானதாகவும் சுதந்திரமானதாகவும் மாற்றுவதில் ஏற்பட்டுள்ள தோல்வி வரை, முந்தைய அரசாங்கங்களுடன் ஒப்பிடுகையில் எந்தவொரு கணிசமான மாற்றங்களையும் நாம் காணவில்லை.
“புதியதொரு யுகம்” என்ற வாக்குறுதி அளிக்கப்பட்ட போதிலும், கண்காணிப்பு மற்றும் அச்சுறுத்தல் நிலைகளே தொடர்ந்து நீடிக்கின்றன. தமிழ் மக்கள் சார்ந்த பிரச்சினைகளை எழுப்பும் ஊடகவியலாளர்களும் செயல்பாட்டாளர்களும் தொடர்ச்சியான துன்புறுத்தல்களுக்கு முகம் கொடுத்து வருகின்றனர். அதேவேளையில், சட்டவிரோத நில ஆக்கிரமிப்புகளுக்கும் இராணுவமயமாக்கலுக்கும் எதிராகப் போராடும் செயல்பாட்டாளர்கள் தொடர் கண்காணிப்பின் கீழ் வைக்கப்பட்டுள்ளதுடன், போராட்டங்களின் போது அடிக்கடி கைது செய்யப்படும் அபாயத்தையும் எதிர்கொள்கின்றனர். பல வருடங்களாக, வலிந்து காணாமல் ஆக்கப்பட்டோரின் குடும்பங்கள் தங்களுக்குப் பிரியமானவர்களுக்கு என்ன நேர்ந்தது என்ற பதில்களுக்காகக் காத்துக்கொண்டிருக்கின்றனர்; அண்மையில் செம்மணி மனிதப்புதைகுழிகள் தோண்டப்பட்ட போதிலும், அதில் எவ்வித உறுதியான முன்னேற்றமும் ஏற்படாதது அவர்களின் வேதனையை மேலும் அதிகரித்துள்ளது. ஐநா மனித உரிமைகள் உயர்ஸ்தானிகர் அலுவலகத்தின் அண்மைய அறிக்கையான “இலங்கையில் மோதல் சார்ந்த பாலியல் வன்முறைகளுக்கான பொறுப்புக்கூறல்” என்பது, போர்க்காலத்தில் தமிழ் மக்களுக்கு எதிராக இழைக்கப்பட்ட கொடூரமான பாலியல் குற்றங்களை மீண்டும் ஒருமுறை அப்பட்டமாக நினைவூட்டுகிறது. இந்த புதிய அரசாங்கத்தின் கீழும் தண்டிப்பிலிருந்து விலக்குபெறும் (தண்டனைவிலக்கு) கலாச்சாரம் தொடர்வதால், மோதல் சார்ந்த பாலியல் வன்முறைகளால் பாதிக்கப்பட்டவர்களும் அதிலிருந்து தப்பிப்பிழைத்தவர்களும் நீதிக்காக இன்னும் காத்துக்கொண்டிருக்கிறார்கள்.
கண்காணிப்பு, அச்சுறுத்தல், சிங்கள-பௌத்தமயமாக்கற் திணிப்பு மற்றும் பொலிஸ் அடாவடித்தனம் ஆகியவை இயல்பானவையாக்கப்பட்டு, அவை ‘அபிவிருத்தி மற்றும் மீள்கட்டமைப்பு’ என்ற முகமூடிக்குள் மறைக்கப்படும் இடத்தில் நீதி ஒருபோதும் நிலைபெற முடியாது. ஆயுத மோதலின் போது இழைக்கப்பட்ட கொடூரமான குற்றங்களுக்கான நீதியையும் பொறுப்புக்கூறலையும் உறுதிப்படுத்தாமல், இடைக்கால நீதி நடவடிக்கைகளாக ‘காணாமல் போனோர் அலுவலகம்’ (OMP) போன்ற தற்போதுள்ள நிறுவனங்களை வலுப்படுத்துவதாக அரசாங்கம் கூறுவது, அது தனக்கு முந்தைய அரசாங்கங்களைப் போலவே தண்டனைவிலக்கு அளிக்கும் அதே பாதையில்தான் தொடர்ந்து பயணிக்கிறது என்பதைத் தெளிவாகக் காட்டுகிறது.
பதினேழு ஆண்டுகள் கடந்த போதிலும், நம்பமுடியாத சவால்களுக்கு மத்தியிலும் நீதியையும் பொறுப்புக்கூறலையும் வென்றெடுப்பதற்கான தமிழ் மக்களின் உறுதியானது தளராது நிலைத்திருக்கிறது. முள்ளிவாய்க்காலில் மடிந்தவர்களை நினைவு கூரும் அதேவேளையில், அவர்களுக்கும், அவர்தம் உறவுகளுக்கும், ஒட்டுமொத்த சமூகத்திற்கும் சேர வேண்டிய நீதியையும் பொறுப்புக்கூறலையும் தொடர்ச்சியாக முன்னெடுப்பதில் ‘அடையாளம் கொள்கை ஆய்வுக்கான நிலையம்’ தனது அர்ப்பணிப்பில் உறுதியாக நிற்கிறது.
